Welcome to Fut x Perform.
These Terms and Conditions ("Terms") govern your use of our website, services, and programs ("Platform"). By accessing or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms in full. If you do not agree, you must not use our services.
Terminology
“Client,” “You,” and “Your” refer to the individual accessing or using the Platform. “Fut x Perform,” “We,” “Our,” and “Us” refer to Fut x Perform and all affiliated entities, partners, and representatives.
1. Services Provided
Fut x Perform provides holistic football development programs designed to enhance players’ technical, tactical, physical, and professional readiness. Services may include training programs, coaching, mentoring, performance analysis, and introductions to clubs, scouts, or licensed intermediaries.

Fut x Perform is not a FIFA-licensed agency or intermediary and does not engage in player representation, contract negotiation, or transfer management. Any introductions or networking support provided are for developmental and informational purposes only. Licensed agents handle all official negotiations and contractual matters.
2. No Guarantee of Outcomes
While we provide professional guidance, resources, and introductions, Fut x Perform does not guarantee specific outcomes such as trials, scholarships, contracts, or club signings. Results depend on multiple external factors including individual performance, effort, fitness, market conditions, and club discretion.
2.1 Player Representation and Legal Authority
Only a licensed agent/intermediary or the player themselves may legally represent or negotiate on behalf of a player. Fut x Perform does not act as an agent or intermediary and will not participate in any formal contract negotiations or representations.
You acknowledge that any opportunities, introductions, or trials facilitated by Fut x Perform are not an offer of representation or employment, and Fut x Perform bears no responsibility for subsequent dealings between you, agents, or clubs.
2.2 Compliance with Governing Bodies
You agree to comply with all applicable rules and regulations set by FIFA, national associations, and football governing bodies. Fut x Perform’s programs are designed to operate within these frameworks and do not replace or override any official registration, licensing, or eligibility requirements.
3. Payments and Subscriptions
Payments may be one-time fees or recurring subscriptions. You agree to pay all applicable fees on time. Subscription renewals are processed automatically unless cancelled at least 21 days before the renewal date. Failure to pay may result in suspension or termination of services.
Fut x Perform reserves the right to recover any outstanding payments, including through third-party collection or legal channels.
3.1 Chargeback Claims
If you initiate an invalid chargeback or dispute causing financial loss to Fut x Perform, we reserve the right to pursue recovery of all related costs. Valid reasons for chargebacks exclude dissatisfaction with results or change of mind.

False or unjustified claims constitute a breach of these Terms and may result in service termination without refund.
4. Refund Policy
Refunds are not outcome-based and are only applicable to fees paid directly to Fut x Perform. Refunds do not include or cover third-party costs such as club fees, travel, accommodation, insurance, or visa expenses.

5. Travel and Trial Costs
All travel, accommodation, and trial-related expenses are the sole responsibility of the client. This may include but is not limited to flights, food, transport, visas, insurance, and club or administrative fees. Fut x Perform is not liable for any costs incurred through participation in trials or events. Any expenses covered are decided at the discretion of the club itself, not Fut x Perform or any of it's agents/partners.
6. Participant Responsibility and Insurance
You are responsible for ensuring that you are medically fit to participate in any training, trial, or event. You agree to obtain appropriate medical, travel, and injury insurance at your own cost.
Fut x Perform shall not be liable for any injuries, damages, or losses sustained during participation or travel related to its programs.
7. Intellectual Property
All materials, logos, designs, training resources, and proprietary tools provided by Fut x Perform are protected by intellectual property laws. You may use them only for personal, non-commercial purposes unless expressly authorized. Unauthorized reproduction, resale, or distribution is strictly prohibited.
8. Behavioural Misconduct and Non-Disparagement
Any form of misconduct — including harassment, abuse, discrimination, or defamation — is strictly prohibited.
You further agree not to publicly defame, disparage, or harm Fut x Perform, its staff, partners, or affiliates, or players including through social media or public forums. Any issues or concerns must be raised privately with Fut x Perform.
Violation of this clause may result in immediate termination without refund and potential legal action.
9. Media and Marketing Rights
By participating in any Fut x Perform program, event, or trial (“Program”), you grant Fut x Perform and its affiliates the right to collect, record, and use your name, image, likeness, voice, testimonials, performance data, and related materials (“Content”) for any purpose, including marketing, promotional, commercial, and service-related uses, in any media worldwide, in perpetuity.
This license is perpetual, royalty-free, transferable, and irrevocable, extending to any future publicity or success resulting from your participation, including subsequent signings or representation by agencies.
You acknowledge that this license shall not be voided or restricted by any later agreement you enter into with agents or media representatives.
You warrant that any content you provide is lawful, original, and does not infringe any third-party rights.
10. Disclaimer of Medical or Professional Advice
All training and guidance provided by Fut x Perform are personal experiences and they do not constitute medical, legal, or psychological advice. You should seek professional advice where necessary.
11. Third-Party Links and Services
The Platform may contain links to third-party websites or services. Fut x Perform is not responsible for, and does not endorse, the content or policies of such third parties. Use of these links is at your own risk.
12. Privacy and Cookies
Please review our Privacy Policy to understand how we collect and use your personal data. Our Platform may use cookies to improve user experience.
13. Limitation of Liability
To the fullest extent permitted by Australian law, Fut x Perform excludes all implied warranties and shall not be liable for any direct, indirect, incidental, or consequential damages arising from your participation in its programs or use of its services.
14. Termination
We reserve the right to suspend or terminate your access to our services at any time for breach of these Terms, including non-payment, misconduct, or violation of the Non-Disparagement or Non-Solicitation clauses. No refunds will be provided in such cases.
15. Force Majeure
Fut x Perform shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including natural disasters, pandemics, strikes, or government restrictions.
16. Dispute Resolution and Arbitration
Any disputes shall first be addressed through good-faith mediation. If unresolved, disputes will be settled by binding arbitration in Australia under applicable laws. Both parties waive the right to court proceedings except to enforce an arbitration award.
17. Governing Law
These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of Australian courts.
18. Changes to Terms
Fut x Perform may update these Terms at any time. Continued use of the Platform constitutes acceptance of any changes.
19. Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, form the entire agreement between you and Fut x Perform, superseding all prior representations or understandings.
