FUTXPERFORM Networking Program — Terms of Service

Welcome to FUTXPERFORM.

By purchasing and participating in a FUTXPERFORM Networking Program ("Program"), you ("Client," "Participant") agree to be legally bound by the following Terms of Service ("Terms"). These Terms constitute the full and exclusive agreement between you and FUTXPERFORM ("Company," "we," "our," or "us").

1. Program Description

A. Consulting Services (Non-FIFA Regulated)

As part of the Networking Program, FUTXPERFORM provides the following consulting services to Participants:

  • Career strategy and planning
  • Player profile development, including CV, highlight reel, and scouting material
  • Introductions to trial opportunities within our network
  • Networking access and support
  • Recommendations on suitable playing opportunities
  • Guidance on travel and trial logistics
  • Ongoing communication and case support
  • Mentorship throughout the Program
  • Online coaching to support player development
  • Education in football networking and career-building skills
  • General football education relevant to the Participant's development

FUTXPERFORM's services are consulting and networking services only. They fall outside FIFA's regulated definition of player representation, and as such do not require a Representation Agreement. FUTXPERFORM may charge an upfront fee for these services in accordance with applicable regulations.

B. Program Pathways

FUTXPERFORM offers two Networking Program pathways. The Terms below apply to both unless a section specifies otherwise.

One Window Pathway A fixed initial term of 3 months, providing support, guidance, and networking opportunities to assist you in exploring potential playing or professional opportunities. This may include introductions to scouts, coaches, sporting directors, CEOs, intermediaries, and licensed agents within our verified football network.

Two Window Pathway A program covering two transfer windows of the Participant's choosing within an 18-month period, providing the same scope of support, guidance, and networking access as above, across both windows.

2. Guarantee

One Window Pathway: If no suitable opportunity results in a signed placement during the initial 3-month term, FUTXPERFORM will continue efforts for an additional 3 months at no extra cost, up to a maximum of 6 months.

Two Window Pathway: If no suitable opportunity results in a signed placement across the Participant's two chosen transfer windows, FUTXPERFORM will continue working the Participant's case at no additional cost into subsequent windows, until a suitable opportunity is presented, subject to the Client Responsibilities in Section 4.

Suitable Opportunity: A suitable opportunity means a trial or signing opportunity that, in FUTXPERFORM's professional judgment, is appropriate to the Participant's playing level, experience, and stated career goals at onboarding.

Presented Opportunity: An opportunity is considered "presented" once FUTXPERFORM provides the Participant with a genuine communication from an external club, coach, sporting director, or licensed agent (including a forwarded message, email, or named contact details from that party). Attendance at a trial or formal club documentation is not required for an opportunity to count as presented, but the opportunity must be traceable to a real, identifiable third party, not internal correspondence alone.

Program Stops When:

  • The Participant signs a contract with a club or agent (program ends immediately).
  • A suitable opportunity is presented and successfully placed (program ends).
  • The applicable guarantee period expires (One Window Pathway only, per Section 2 above).

Notes:

  • Trials or introductions do not end the program unless they result in a signed agreement.
  • Participants retain full access to the program and platform for the duration of their term, regardless of whether earlier opportunities occur.
  • Early trial participation does not reduce or stop program access, even if the opportunity is ongoing or incomplete.

Disclaimer: FUTXPERFORM is not a FIFA-licensed agency or intermediary. We do not represent players, negotiate contracts, or manage transfers. Introductions or networking support are for informational and developmental purposes only. Licensed agents, or the player themselves/parent/guardian if underage, handle all official negotiations and representation.

3. Service Commitment

  • By joining a Program, you commit to the fixed term applicable to your selected pathway (Section 1).
  • The Program is non-cancellable and non-refundable once purchased, except as expressly set out in Section 6 (Payments).
  • All services, including research, outreach, strategy, and communication, are performed at our discretion within the defined timeframe.
  • Any complimentary extensions or continued efforts are conditional upon the Participant meeting their responsibilities under Section 4.
  • FUTXPERFORM reserves the right to modify program content or scheduling if necessary, while maintaining guarantee obligations under Section 2.

4. Client Responsibilities

To remain eligible for service continuation and the applicable guarantee, you agree to:

  • Respond to all communications and opportunities within 48 hours.
  • Be active and send a message on the official program platform (Discord) at least once every 7 days. Activity on WhatsApp, Instagram, or other channels is not considered official.
  • Keep FUTXPERFORM informed about your availability, injuries, and fitness status.
  • Provide honest and accurate information about your experience, playing level, and background.
  • Follow through on all agreed-upon steps from onboarding, check-ins, strategy calls, or mentorship sessions, including any specific requirements identified by FUTXPERFORM as necessary to your placement (see Match Footage Requirement below).

Match Footage Requirement: Where FUTXPERFORM identifies during a strategy call or check-in that a Participant requires additional or updated match footage to be competitive for suitable opportunities, the Participant must provide this footage within the timeframe agreed with FUTXPERFORM. Failure to do so releases FUTXPERFORM from the guarantee obligations under Section 2, as the absence of adequate footage directly limits FUTXPERFORM's ability to present suitable opportunities.

Inactive Player Policy: Failing to engage for 7 consecutive days (not acknowledging or responding to messages, requests, or opportunities on Discord) voids the guarantee under Section 2 and may negatively impact network exposure. FUTXPERFORM is not responsible for missed opportunities due to inactivity.

Guarantee Exclusions: The guarantee under Section 2 does not apply where:

  • The Participant declines an opportunity deemed suitable by FUTXPERFORM under Section 2.
  • The Participant pursues opportunities outside the FUTXPERFORM network during the Program term.
  • The Participant fails to meet the Match Footage Requirement above.
  • The Participant engages in unprofessional conduct toward FUTXPERFORM staff, representatives, or third-party contacts, as determined by FUTXPERFORM.

5. No Outcome Guarantees

FUTXPERFORM provides professional effort, time, and access to our network, but does not guarantee trials, contracts, signings, or club placements.

The only guarantees are the continuation periods described in Section 2. These are the sole remedy available and do not entitle Participants to refunds, additional extensions beyond what is specified, or other compensation.

Our program focuses on real, meaningful opportunities designed to maximize a player's long-term career potential. We do not create pre-arranged or token opportunities simply to meet a timeline or satisfy a guarantee, every introduction and trial is intended to give the player the best possible outcome for their development and professional future.

6. Payments, Chargebacks, and Disputes

  • All program fees are final and non-refundable except as expressly set out below.
  • Participants electing a split-payment option agree to pay the second installment by the date agreed at onboarding.
  • If the second payment is not received within 28 days of the agreed due date, and no alternative arrangement has been approved in writing by FUTXPERFORM, the Participant's position in the Program is forfeited along with all prior payments made.
  • Participants agree not to initiate any chargeback, refund, or payment dispute. Attempting to reverse or dispute a payment is a material breach of these Terms, and FUTXPERFORM reserves the right to pursue recovery of costs, damages, and legal fees.

7. Player Representation and Legal Authority

  • FUTXPERFORM does not represent players or negotiate contracts.
  • All official representation or negotiations must be handled by a licensed agent/intermediary, or by the player themselves, or their parent/guardian if underage.
  • Introductions to agents, clubs, or scouts are solely networking opportunities. Participants are fully responsible for any agreements, contracts, or negotiations they enter into thereafter.

8. Compliance with Football Regulations

Participants must comply with all relevant football regulations, including those of FIFA, national associations, and local federations. FUTXPERFORM's services operate within these frameworks and are not a substitute for formal registration, licensing, or legal requirements.

9. Participant Responsibility & Insurance

  • Participants confirm they are medically fit for training, trials, or travel associated with introductions.
  • Participants are responsible for maintaining appropriate health, injury, and travel insurance.
  • FUTXPERFORM accepts no liability for injuries, travel issues, or losses during trials, introductions, or events.

10. Travel and Related Costs

  • All travel, accommodation, and trial-related expenses are the Participant's responsibility. This includes, but is not limited to, flights, lodging, food, transportation, visas, insurance, and club fees.
  • In certain instances, clubs may provide assistance with accommodation, flights, or other arrangements. Any such support is at the sole discretion of the club and does not shift responsibility from the Participant.
  • FUTXPERFORM does not reimburse or cover any expenses, and is not responsible for visa, regulatory, or compliance issues. Participants must ensure they meet all travel, insurance, and local requirements independently.

11. Confidentiality and Intellectual Property

  • All proprietary information, contacts, materials, and communications provided during the Program are confidential and remain the property of FUTXPERFORM.
  • Participants may not share, sell, or distribute any information without prior written consent.
  • All resources, strategies, documentation, branding, and systems remain the intellectual property of FUTXPERFORM.
  • Unauthorized use or disclosure may result in legal action, including claims for damages and injunctions, at FUTXPERFORM's discretion.

12. Player Image and Media Rights

By joining the Program, Participants grant FUTXPERFORM a perpetual, worldwide, royalty-free, non-exclusive license to use their name, image, likeness, voice, testimonials, and related content ("Content") for promotional, marketing, or operational purposes. Participants waive any claim for compensation regarding such use. Rights remain valid even if the Participant later signs exclusive agreements with agents, clubs, or sponsors.

13. Client Conduct & Non-Disparagement

  • Participants must maintain professionalism and integrity throughout the Program.
  • Participants agree not to defame, disparage, or harm FUTXPERFORM, its staff, partners, or affiliates publicly.
  • Any unprofessional behavior, dishonesty, or reputational harm may result in immediate termination without refund and potential legal consequences.

14. Force Majeure

FUTXPERFORM is not liable for delays or failure to perform obligations due to events beyond reasonable control, including natural disasters, wars, government restrictions, pandemics, or internet outages.

15. Limitation of Liability

To the fullest extent permitted by Cypriot law, FUTXPERFORM disclaims all warranties and is not liable for indirect, incidental, or consequential damages arising from participation in the Program or reliance on its materials or introductions.

16. Entire Agreement

These Terms constitute the full and final agreement regarding the Networking Program. They supersede all prior discussions or communications. Any amendments must be in writing and signed by both parties.

17. Governing Law and Jurisdiction

This agreement is governed by the laws of Cyprus. Any disputes are subject to the exclusive jurisdiction of the courts of Cyprus.
