FUTXPERFORM — Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of all FUTXPERFORM services, content, programs, platforms, and communications (collectively, the "Services").

By accessing, using, or purchasing any FUTXPERFORM Services, you agree to be bound by these Terms.

1. Scope of Services

FUTXPERFORM provides football-related consulting, development, networking, and educational services.

This includes, but is not limited to:

  • Player development guidance
  • CV and highlight creation
  • Profile positioning
  • Access to opportunities and scouting insights
  • Introductions to clubs, scouts, and licensed agents
  • Mentorship and advisory services
  • Access to digital platforms, communities, and resources
  • Media, content, and educational materials

These Terms apply to all current and future services, regardless of the specific program or offer.

2. Nature of Services

FUTXPERFORM operates as a consulting and networking service.

You acknowledge that:

  • Services are designed to provide access, exposure, and strategic support.
  • FUTXPERFORM does not provide employment or guaranteed placement.
  • Any introductions, referrals, or opportunities constitute delivery of service.
  • Outcomes depend on third-party decision-makers (clubs, coaches, etc.).

We do not guarantee:

  • Trials
  • Contracts
  • Club placements
  • Scholarships

3. No Representation (Regulatory Compliance)

FUTXPERFORM is not a FIFA-licensed agent or intermediary.

We do not:

  • Represent players in negotiations.
  • Enter into contracts on behalf of players.
  • Act as a legal intermediary.

All formal representation must be conducted by the player or a licensed agent.

4. Client Responsibilities

You agree to:

  • Provide accurate information.
  • Actively engage with the Services.
  • Provide requested materials (e.g. footage, data).
  • Respond to communications.
  • Conduct yourself professionally.

Failure to engage may affect results. FUTXPERFORM is not responsible for outcomes impacted by lack of participation.

5. Payments and Commercial Terms

All fees are payable as agreed at the point of purchase.

You acknowledge:

  • Fees are for access to services, expertise, and networks.
  • Payments are not contingent on outcomes.
  • Services may begin immediately upon onboarding.

Failure to complete payments may result in suspension or termination of Services.

6. Refunds and Chargebacks

All payments are subject to our Refund Policy.

You agree that:

  • Services are not outcome-based.
  • Partial or full service delivery may occur early.
  • Once onboarding, materials, or platform access is provided, services are deemed commenced.

Invalid chargebacks or disputes may result in:

  • Immediate termination.
  • Recovery of costs, including legal and administrative fees.

7. Intellectual Property

All content, materials, systems, and resources provided by FUTXPERFORM are the exclusive property of FUTXPERFORM and are protected under the laws of Cyprus and applicable international laws.

This includes:

  • Training materials and frameworks
  • Documents, templates, and player resources
  • Videos, media, and content
  • Platform systems and opportunity feeds
  • Databases, contacts, and internal processes

You are granted a limited, non-exclusive, non-transferable license for personal use only.

You may not:

  • Copy, reproduce, distribute, or resell any materials.
  • Share access with third parties.
  • Use our content, systems, or contacts for commercial purposes.

Any unauthorised use constitutes a breach and may result in legal action.

8. Non-Circumvention

You agree not to:

  • Bypass or circumvent FUTXPERFORM.
  • Directly engage with any club, scout, agent, or contact introduced through our Services.

This restriction applies for a period of 24 months, without prior written consent.

9. Platform Use and Access

FUTXPERFORM may provide access to digital platforms (e.g. Discord, CRM systems, or similar tools).

You acknowledge:

  • These platforms are part of the Services.
  • You are responsible for engaging with them.
  • Access is personal and may not be shared.

FUTXPERFORM is not responsible for missed opportunities due to failure to engage on official platforms.

10. Third-Party Relationships

All interactions with third parties (clubs, agents, organisations) are:

  • Independent of FUTXPERFORM.
  • At your own risk.

We are not responsible for:

  • Decisions made by third parties.
  • Contracts entered into.
  • Outcomes resulting from those relationships.

11. Travel, Costs, and Expenses

All travel and related expenses are your responsibility, including:

  • Flights
  • Accommodation
  • Visas
  • Insurance
  • Transport and living costs

FUTXPERFORM does not cover these costs.

12. Health and Participation

You are responsible for ensuring you are medically fit to participate in any activity.

You agree to obtain appropriate insurance.

FUTXPERFORM is not liable for injuries or losses sustained.

13. Media and Content Rights

By engaging with FUTXPERFORM, you grant us the right to use your:

  • Name, image, likeness, and performance data
  • Testimonials and results

For marketing, promotional, and commercial purposes worldwide, in perpetuity.

14. Conduct and Misuse

You agree not to:

  • Engage in abusive, unlawful, or harmful behaviour.
  • Misuse the platform or Services.
  • Publicly defame or disparage FUTXPERFORM.

Breach may result in termination without refund.

15. Limitation of Liability

To the fullest extent permitted by law, FUTXPERFORM is not liable for:

  • Indirect or consequential losses
  • Missed opportunities
  • Third-party decisions

16. Termination

We may suspend or terminate access at any time for:

  • Breach of Terms
  • Non-payment
  • Misconduct

No refunds will be provided in such cases.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Cyprus. Any disputes are subject to the exclusive jurisdiction of the courts of Cyprus.

18. Changes to Terms

We may update these Terms at any time.

Continued use of the Services constitutes acceptance.

19. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, form the entire agreement.
